Digital Living Art Photo guide

Terms for artists

Your work stays yours

This is what we agree with every artist who publishes a gallery at Digital Living Art. It is written to be understood, not to hide anything. If something doesn't sit right with you, write to us before paying.

  1. What we do

Digital Living Art publishes your virtual gallery at digital-living.art, with the works you upload, your introduction and your links. We also animate, with artificial intelligence, as many works as the plan you choose includes, so they move in your gallery.

  2. Your work is yours

You keep every right over your works. You assign us no ownership, we ask for no exclusivity, and you can go on exhibiting, selling or publishing your work wherever you like, at the same time.

  3. What you authorise us to do

While your gallery is published, you authorise us to:

    • Show digital reproductions of the works you upload, in your gallery on the site.
    • Create an animated version of the works you choose and show it in your gallery.
    • Use images or fragments of your work and its animation to promote your gallery and Digital Living Art's shows, always under your name and without altering the work beyond the approved animation.

This is a non-exclusive, royalty-free authorisation for us, limited to these uses.

  4. Nothing is published without your approval

We show you every animation before publishing it. Each animation includes one change: if the first version doesn't convince you, tell us what you would change and we redo it. Then we show you both, the first and the new one, and you choose which to keep. If neither works for you, we can swap it for another work.

  5. The animation

The animation is a work derived from yours, made with your permission. Using artificial intelligence does not create rights on its own: what our team contributes is the direction of the work, that is, what moves and how, the trials and the curation until you approve it.

Your work is not altered. The animation gives it slight movement, looped: water running, cloth in the wind, leaves, smoke, light changing slowly. The composition, the framing and the colours stay as you made them. We do not rotate or spin the work, we do not zoom or pan across it, we do not change its colours or add elements that are not there. If you ask for something like that, we write to you so we can think it through together: the limit is that it has to remain your work.

The format may vary. Photos of artworks rarely have standard dimensions: some are square, others more upright or wider. The animation shows your whole work in its own proportions, without stretching or cropping it. Depending on the photo, the final video format may vary slightly and, if the frame needs filling, we use your own work, blurred, at the edges.

Ownership of the animation is shared between you and Digital Living Art.

The animation can only be seen on Digital Living Art. The video file is neither handed over nor downloadable, to you or to anyone. To show it, you share the link: every living work has its own page on the site, with the work moving and the credit, for you to put on your social media, in your bio or wherever you like. We can only show it on our own site, at our own shows and on our social media, with the agreed credit: for any other use we ask your permission first, every time.

The agreed credit. Every time the animation is published or exhibited, it carries this credit: “Title of the work”, your name (year) · Animation: Digital Living Art. It goes in your gallery, on the work's page, in whatever we publish and on the label at every show. Your name always comes first, because the work is yours. If you want to appear differently, under a pseudonym for example, we agree it when you approve the animation and it stays that way.

  6. Promotion on our social media

Every plan includes being featured on our Instagram account and in our campaigns. What we post, when and in what format is our decision, as part of the communications of Digital Living Art.

Collaboration posts, the ones that also appear on your profile, are not included in any plan: we make them when we decide to, according to your plan and our communications strategy. If we invite you to one, you get the Instagram invitation and you choose whether to accept it. Everything we post carries the agreed credit.

  7. How long it lasts

Your gallery lasts two months, counted from the day we set up your account, which is the day you pay. You publish it yourself, when you like how it looks: the sooner you publish, the longer it stays online. Before the time is up we write to you so you can renew, change plan or add works. If you do not renew, the gallery is taken down.

  8. Refunds and cancellation

You have 3 days to change your mind. If you change your mind within 3 days of your payment, and you have not asked us for any animation yet, we refund 100% of what you paid.

After that, or once you ask us for an animation, the period already paid is not refunded. That is when the work of digitising, animating and publishing your work begins. You can leave whenever you want: email us and we take down a work or your whole gallery within five working days. The animations you approved stay yours all the same.

If something does not work as we promised, write to us: we fix it or refund the period.

By paying, you ask us to start working right away and you accept that, after the 3 days or once you ask us for an animation, you can no longer withdraw from the purchase.

To request a refund or cancel: hola@digital-living.art. Refunds are made through the same method you paid with.

  9. What you warrant

    • That the works are yours, or that you hold the rights to publish them and to authorise their animation.
    • That the photos you send are yours, or that you have permission from whoever took them.
    • That the work infringes no third-party rights.

If a claim arises over a work you uploaded, you take responsibility and we take it down while it is resolved.

  10. What we don't publish

Work that is not yours, content inciting hatred or violence, sexually explicit content, and work generated entirely by artificial intelligence without an authorial process of your own. If in doubt, we talk about it first.

  11. Payment

The chosen plan is paid in advance, and it sets how many works you publish and how many come alive. The price includes producing those animations, the gallery and its publication for two months. Digitising physical work, if needed, is charged separately.

  12. Your data

We keep your name, your email and the details you upload, only to provide the service and to contact you. We neither sell nor share them. You can ask us to access, correct or delete them whenever you want (Argentine Personal Data Protection Act 25.326).

  13. The people who look at your work

The experiences through which the public meets your work look after whoever is looking:

    • Augmented art and Miradas use the camera only on the phone or screen of the person looking. The image is processed right there: it is not recorded, not sent anywhere and not stored. Augmented art points at the work, not at people.
    • Miradas recognises no one. It reads expression (attention, enjoyment, wonder), not identity. To do so it places reference points on the face (the so-called landmarks) and works out how strongly each expression is activated, such as the smile, the eyebrows or the mouth (blendshapes). It does not use the iris or the direction of the gaze: it only takes into account where the head is pointing, whether the eyes are open and the expressions, and discards it instantly. There is no facial recognition, and no biometric data is created or stored: nothing that could identify a person. The card with the record of the visit stays on that person's phone, and they share it only if they want to.
    • Obra Viva uses no camera and asks for no data: visitors scan the code with their phone and watch.
    • The statistics you see in your dashboard are aggregate figures: how many people came in, from which country or city and which works they looked at. Never who they were.
    • If someone writes to you from your gallery, their name and email reach you, with a copy to us, only so that you can reply.

We do not sell, rent or trade anyone's information, neither yours nor that of the people who visit your gallery, and we do not use it for advertising. People's identity is kept private. The details of what the site stores are at digital-living.art/en/privacy.

  14. If we change these terms

We tell you by email. Changes apply from the following period: what we agreed when you paid holds until it ends.

  15. Governing law

The laws of the Argentine Republic apply and, in the event of any dispute, the ordinary courts of the City of Buenos Aires. Before that, we talk.
